An enduring power of attorney is a power of attorney given when a person (the donor) is of sound mind that is intended to endure should the donor lose his/her mental capacity at a future date. The advantage of executing an enduring power of attorney is that the donor can decide who he or she would like to manage his or her affairs in these circumstances.
Including: divorce, grounds for divorce, separation agreement and children.
We deal with all aspects of landlord and tenant law including the buying and selling of leasehold premises, the preparation of leases for letting, leases for commercial premises and, where necessary, issuing and pursuing of court proceedings, eg. for non-payment of rent and possession.
All premises selling alcoholic liquor must be licensed. Obtaining a liquor licence involves an application to Licensing Court presided over by the High Bailiff or the Deputy High Bailiff.
When a person loses mental capacity but has not made an enduring power of attorney it is necessary for a mental health receiver to be appointed by the Court to manage their financial affairs. A close relative or sometimes a longstanding friend can often be appointed receiver but the receiver must reside on the island. Alternatively, and where there is no suitable relative or friend, a professional receiver is appointed, normally an advocate or accountant.
The sale and purchase of a business generally involves the assignment of goodwill and other assets including the fixtures and fittings of the premises where the business is run and often the sale of the business premises or the assignment of a lease of the premises.
