An enduring power of attorney is a power of attorney given when a person (the donor) is of sound mind that is intended to endure should the donor lose his/her mental capacity at a future date. The advantage of executing an enduring power of attorney is that the donor can decide who he or she would like to manage his or her affairs in these circumstances.
When a donor loses mental capacity, the enduring power of attorney must be registered at the court. The application to register the enduring power of attorney must be supported by a report from a consultant psychologist or other suitable medical practitioner. Formal notices must be served on the donor and on the next of kin.
With more people living longer sadly there are an increasing number of people losing mental capacity and more enduring powers of attorney are being registered.
This is often a difficult and distressing time for the family. We are able to help make things easier and to ensure that the enduring power of attorney is registered promptly as it is often quite urgent for the donee to be able to deal with the donor’s affairs.
